1. Acceptance of Terms

By accessing, browsing, or using the Glewell Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Cookie Policy, Community Guidelines, and any other policies or guidelines incorporated by reference.

1.2 Additional Terms

Certain features, services, or promotions may be subject to additional terms and conditions, which will be presented to you at the time of use. In the event of a conflict between these Terms and any Additional Terms, the Additional Terms will govern with respect to that specific feature or service.

2. Changes to Terms

2.1 Right to Modify

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be necessary due to legal, regulatory, or operational reasons, or to improve the Service.

2.2 Notice of Changes

When we make material changes to these Terms, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify you via email (to the address associated with your account)
  • Display a prominent notice on the Service

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old.

Users under the age of 18 are strictly prohibited from creating an account or using the Service in any capacity. We may request proof of age at any time, and accounts found to belong to users under 18 will be immediately terminated.

By using the Service, you represent and warrant that:

  • You have the legal capacity and authority to enter into these Terms
  • You are not prohibited from using the Service under the laws of your jurisdiction
  • All information you provide to us is accurate, current, and complete
  • You will maintain the accuracy of such information

3.3 Age Verification

We reserve the right to verify your age at any time. You may be required to provide government-issued identification or other documentation to confirm that you meet the minimum age requirement. Failure to provide such verification, or provision of false information, will result in immediate account termination.

3.4 Health and Safety Considerations

4. Description of Service

4.1 Service Overview

Glewell is an all-in-one wellness platform that provides users with tools and resources for health and fitness management, including but not limited to:

  • Food Logging & Nutrition Tracking: Track meals, calories and macronutrients
  • Fitness & Workout Tracking: Log exercises, track progress, and monitor physical activity
  • AI-Powered Personalized Coaching: Receive personalized recommendations and insights based on your data
  • Wellness Community: Connect with other users, share experiences, and participate in discussions
  • Meal Planning & Recipes: Access meal plans and recipes tailored to your dietary preferences
  • Data Analytics & Reports: View comprehensive analytics and insights about your health data

4.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will make reasonable efforts to notify you of material changes that negatively affect your use of the Service.

4A. Accessibility and Disability Rights

4A.1 Commitment to Accessibility

Glewell is committed to making our Service accessible to users with disabilities. We strive to comply with:

  • Web Content Accessibility Guidelines (WCAG) 2.1 Level AA for our web-based platforms

  • User-generated content posted by community members
  • Third-party integrations, apps, or websites linked from our Service
  • Content from external databases or APIs

4A.5 Reporting Accessibility Issues

  2. Include the page URL, device/browser information, and description of the issue
  3. Attach screenshots or screen recordings if possible

4A.6 Assistive Technology Compatibility

The Service is designed to work with:

  • Screen readers (JAWS, NVDA, VoiceOver, TalkBack, ChromeVox)
  • Voice control software (Dragon NaturallySpeaking, Voice Access)
  • Switch access and alternative input devices
  • Screen magnification software (ZoomText, Windows Magnifier)

Note: Some advanced features (such as complex data visualizations or interactive charts) may have limited accessibility. Alternative accessible formats are available upon request.

5. Medical Disclaimer and Health Information

5.1 General Disclaimer

All content, features, recommendations, and information provided through the Service, including AI-generated coaching, meal plans, workout plans, and health insights, are for informational and educational purposes only. They do not constitute professional medical, health, fitness, nutritional, or therapeutic advice.

5.2 Consult Healthcare Professionals

YOU SHOULD ALWAYS CONSULT WITH A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE:

  • Starting any new diet, nutrition, or meal plan
  • Beginning any exercise, fitness, or workout program
  • Making changes to your current health, fitness, or wellness routine
  • Taking any dietary supplements or vitamins
  • Making health decisions based on information from the Service

5.3 Emergency Situations

THE SERVICE IS NOT FOR EMERGENCY USE. If you are experiencing a medical emergency, call your local emergency services immediately. Do not use the Service to seek help for urgent medical issues.

5.4 No Doctor-Patient Relationship

Use of the Service does not create a doctor-patient, therapist-patient, nutritionist-client, or any other professional healthcare relationship between you and Glewell, its employees, contractors, or affiliated professionals.

5.5 Risks of Physical Activity

Exercise and physical activity involve inherent risks, including but not limited to muscle strains, sprains, injuries, cardiovascular events, aggravation of existing medical conditions, and other health complications. By using the fitness features of the Service, you acknowledge these risks and assume full responsibility for your participation in any physical activity.

5.6 Data Accuracy and Health Advice Limitations

Data Accuracy Limitations:

  • Nutritional Data: Food database nutritional information is sourced from third parties and user contributions. Accuracy cannot be guaranteed. Nutritional values may vary based on preparation methods, brands, and serving sizes
  • Calorie Burn Estimates: Calorie expenditure calculations are estimates based on general formulas and may not reflect your actual energy expenditure
  • Wearable Device Data: Data synced from fitness trackers, smartwatches, and health devices may be inaccurate due to device limitations, calibration, placement, or technical errors
  • Body Composition Estimates: BMI, body fat percentage, and other body composition metrics are estimates and may not be medically accurate
  • AI Recommendations: AI-generated suggestions are based on algorithms and data patterns, not personalized medical assessment
  • User-Generated Content: Information shared by other users in the community is not verified and may be inaccurate or inappropriate

Professional Consultation Required:

  • Always consult licensed healthcare providers before making health, fitness, or nutrition decisions
  • Do not self-diagnose or make treatment decisions based on Service data
  • Discuss Service data with your doctor for proper interpretation in the context of your medical history
  • Seek immediate medical attention for any concerning symptoms or health changes
  • Do not delay seeking professional care based on information from the Service

Disclaimer of Medical Accuracy: We make no representations or warranties regarding the accuracy, completeness, reliability, or medical validity of any health-related information, calculations, estimates, or recommendations provided through the Service.

6. User Accounts and Security

6.1 Account Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials (email and password)
  • All activities that occur under your account
  • Any actions taken by anyone using your account, whether authorized or unauthorized
  • Notifying us immediately of any unauthorized use or security breach

6.2 Account Security

You agree to:

  • Create a strong, unique password that is not used for other accounts
  • Never share your account credentials with any third party
  • Log out of your account after each session, especially on shared devices
  • Enable two-factor authentication if offered

7. Subscription Plans and Pricing

7.1 Subscription Options

Glewell offers the following subscription plans:

7.2 Price Changes

We reserve the right to change subscription prices at any time with at least 30 days' advance notice. Current subscribers will receive at least one full billing cycle notice before any price increase.

8. Payment Terms

8.1 Automatic Renewal

ALL SUBSCRIPTIONS AUTOMATICALLY RENEW unless you cancel before the end of the current billing period.

8.2 Failed Payments

If a payment fails or is declined:

  • We will attempt to process payment multiple times over the following days
  • You will receive email notifications of failed payment attempts
  • Your access to the Service may be suspended or downgraded
  • Your account may be terminated if payment is not received within a reasonable time

9. Free Trials and Promotional Offers

9.1 Free Trial Eligibility

From time to time, we may offer free trials of the Service. Free trials:

  • Are available only to new users who have not previously subscribed
  • Require valid payment information at sign-up
  • Automatically convert to a paid subscription at the end of the trial period unless canceled
  • Are limited to one (1) per user

10. Refund and Cancellation Policy

10.1 General No-Refund Policy

IMPORTANT: Glewell operates a limited refund policy. All payments are generally non-refundable except as explicitly outlined below.

10.2 Eligible Refund Circumstances

Refunds will be considered only in the following circumstances:

  • Platform Fault: Prolonged service outage preventing access to core features (more than 48 consecutive hours)
  • Billing Errors: Duplicate charges or incorrect amounts charged
  • Digital Product Not Accessed: Refund requested within 48 hours of purchase with zero or negligible usage
  • Medical Issues: Documented medical condition preventing use (requires medical documentation)

10.3 Refund Exceptions (No Refunds)

10.4 Subscription Cancellation

You may cancel your subscription at any time through your account settings or by emailing support@glewell.com. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the paid period.

10.5 Automatic Renewal Reminder

AUTOMATIC RENEWAL NOTICE:

  • All subscriptions automatically renew unless you cancel before the renewal date
  • Monthly: Renews on the same day each month (e.g., if you subscribed on the 15th, renews on the 15th)
  • Annual: Renews on the anniversary date of your original subscription
  • Cancel Anytime: Cancel before the renewal date to avoid being charged
  • No Partial Refunds: If auto-renewal occurs, no refunds for the new billing period unless you qualify under Section 10.2

How to Prevent Auto-Renewal:

  1. Log into your account
  2. Go to Settings > Subscription > Manage Subscription
  3. Click "Cancel Subscription"
  4. Confirm cancellation
  5. You will receive email confirmation

Your Responsibility: It is your responsibility to cancel before the renewal date if you do not wish to continue. Setting calendar reminders is recommended.

11. User Content and License

11.1 Definition of User Content

"User Content" means any content, materials, data, information, text, images, photos, videos, audio, messages, posts, comments, or other materials that you submit, upload, post, display, or transmit through the Service.

11.2 User Ownership

You retain all ownership rights to your User Content. We do not claim ownership of any User Content you submit through the Service. Your personal data, health information, food logs, fitness data, and other content remain yours.

11.3 Music, Audio, and Multimedia Copyright

IMPORTANT: You are solely responsible for ensuring you have all necessary rights to any music, audio, video, or multimedia content you upload or share through the Service.

Examples of Copyright Infringement:

  • Using copyrighted music in workout videos: Adding commercial songs to your workout videos without permission
  • Posting videos with background music: Sharing videos that include copyrighted music playing in the background
  • Audio clips from songs: Using portions of copyrighted songs in posts or challenges
  • Video clips from movies/TV: Posting clips from copyrighted movies, TV shows, or online videos
  • Unlicensed podcast content: Sharing audio from podcasts or other sources without permission

Safe Alternatives:

  • Use royalty-free music from licensed libraries (YouTube Audio Library, Free Music Archive, etc.)
  • Use music from Creative Commons sources with proper attribution
  • Create your own original music or audio content
  • Record videos without copyrighted music in the background

Copyright Violations May Result In:

  • Immediate removal of infringing content
  • Warning or account suspension
  • Permanent account termination for repeat violations
  • Legal action by copyright owners
  • Liability for copyright infringement damages

11.4 License Grant to Glewell

By submitting User Content, you grant Glewell a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works based on your User Content solely for the purpose of operating, improving, promoting, and providing the Service.

11.5 Termination of License

The license you grant to Glewell for your User Content:

  • Continues as long as your account is active
  • Terminates upon account deletion, except for content that has been shared with other users (e.g., public posts, comments) which may remain visible (with your username removed)
  • Survives for aggregated, anonymized data used for analytics and service improvement
  • Requires explicit consent for continued use in marketing materials after account deletion

11.6 Backup and Deletion

Regarding your content:

  • Backup Copies: We maintain backup copies for disaster recovery, which may persist for up to 90 days after deletion
  • Deletion Requests: You can request content deletion at any time via Settings > Privacy & Data > Delete Content
  • Permanent Deletion: Content is permanently deleted within 30-90 days (subject to legal retention requirements)
  • Export Before Deletion: You can export your content before account deletion (see Section 14C)

11.7 Your Representations

By submitting User Content, you represent and warrant that:

  • You own or have all necessary rights to the content
  • The content does not infringe any third-party intellectual property rights
  • The content complies with all applicable laws and these Terms
  • You have obtained all necessary consents, releases, and permissions (e.g., if content includes other people)

12. Intellectual Property Rights

12.1 Glewell's Proprietary Rights

The Service and all content, features, and functionality (excluding User Content) are owned by Glewell and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

12.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

12.3 DMCA Copyright Infringement Claims

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed on our Service, please submit a DMCA notice to our designated agent:

Your DMCA notice must include:

  • Signature: Your physical or electronic signature
  • Identification of Work: Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works)
  • Location of Infringing Material: Identification of the allegedly infringing material with sufficient detail for us to locate it (URL, username, post ID, etc.)
  • Contact Information: Your name, address, telephone number, and email address
  • Good Faith Statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • Accuracy Statement: A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner

12.4 DMCA Counter-Notification

If your content was removed due to a DMCA complaint and you believe the removal was erroneous or the material is not infringing, you may submit a counter-notification to legal@glewell.com with:

  • Your physical or electronic signature
  • Identification of the removed material and its former location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, phone number, and consent to jurisdiction

12.5 Repeat Infringer Policy

We will terminate the accounts of users who are repeat copyright infringers. A user may be considered a repeat infringer if:

  • They have received multiple valid DMCA takedown notices
  • They repeatedly upload content known to infringe copyright
  • They ignore warnings about copyright violations

13. Prohibited Uses and Conduct

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service for any illegal, harmful, or unauthorized purpose
  • Interfere with or disrupt the Service or servers or networks
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems (bots, scrapers) without our written permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, threaten, or harm other users
  • Upload viruses, malware, or other malicious code
  • Collect or harvest information about other users
  • Create multiple accounts to abuse features or bypass restrictions

14. Community Guidelines and Moderation

Our community features are designed to provide a supportive, respectful environment. You agree to:

  • Be respectful, kind, and supportive to all community members
  • Refrain from posting illegal, harmful, threatening, or abusive content
  • Not post sexually explicit, obscene, or pornographic material
  • Not promote violence, discrimination, or hate speech
  • Not share false, misleading, or fraudulent information
  • Respect the privacy of others and not share their personal information

We reserve the right to remove, edit, or disable any content that violates these guidelines or is harmful to the community.

14A. Challenges, Competitions, and User-Generated Events

14A.1 Participation Terms

Glewell allows users to create and participate in fitness challenges, competitions, and community events ("Challenges"). By participating, you agree to:

  • Follow all challenge rules and requirements set by the challenge creator and Glewell
  • Accurately report your progress and not falsify results
  • Respect other participants and engage in fair competition
  • Consult with healthcare professionals before participating if you have any medical conditions
  • Assume all risks associated with physical activities undertaken as part of challenges

14A.2 Challenge Content and Media

When you post content (photos, videos, audio, progress updates) related to challenges:

  • You grant other challenge participants the right to view and interact with your challenge-related content
  • You may NOT include copyrighted music, video clips, or other protected materials without proper rights or licenses (see Section 11.3)
  • You agree that challenge winners and top performers may be featured in Glewell marketing materials with proper attribution
  • You retain ownership of all content you post, but grant Glewell a license to use challenge content for promotional purposes

14A.3 Prizes and Awards

Some challenges may offer prizes, awards, or recognition. Additional terms may apply:

  • Prize eligibility requirements will be specified in each challenge
  • Glewell reserves the right to verify results before awarding prizes
  • Prize winners may be required to provide additional information for tax or shipping purposes
  • No cash alternative will be offered unless specified
  • Glewell is not responsible for prizes offered by third-party challenge creators

14A.4 Disqualification

You may be disqualified from challenges for:

  • Falsifying data or results
  • Cheating or using unauthorized assistance
  • Violating challenge rules or community guidelines
  • Posting infringing or inappropriate content
  • Unsportsmanlike conduct

14A.5 Liability Waiver

BY PARTICIPATING IN CHALLENGES, YOU ACKNOWLEDGE AND AGREE THAT:

  • Challenges involve physical activity with inherent risks
  • You participate voluntarily and at your own risk
  • Glewell is not responsible for injuries, accidents, or health issues resulting from challenge participation
  • You should consult healthcare professionals before undertaking intense physical challenges
  • You release Glewell from all liability related to challenge participation

14B. Wearable Devices and Third-Party Integrations

14B.1 Device Integrations

Glewell integrates (or will) with various wearable fitness devices, health platforms, and third-party services (collectively, "Connected Devices"). These may include:

  • Fitness trackers and smartwatches (Apple Watch, Fitbit, Garmin, etc.)
  • Health apps and platforms (Apple Health, Google Fit, Samsung Health)
  • Smart scales and body composition analyzers
  • Heart rate monitors and blood pressure devices
  • Continuous glucose monitors (CGMs) and other medical devices
  • Sleep tracking devices

14B.2 Data Syncing and Accuracy

When you connect devices to Glewell:

  • You authorize the automatic syncing of data from Connected Devices to Glewell
  • Glewell is not responsible for the accuracy, completeness, or reliability of data from Connected Devices
  • Data quality depends on device calibration, placement, and usage - not all data may be medically accurate
  • You can disconnect devices at any time through your account settings
  • Historical data may remain in your Glewell account after disconnecting a device

14B.3 Third-Party Device Terms

Your use of Connected Devices is governed by:

  • The device manufacturer's terms of service and privacy policies
  • Third-party platform terms (Apple, Google, etc.)
  • Any licensing or subscription agreements with device providers

Glewell is not responsible for: device malfunctions, data breaches at device companies, changes to third-party APIs, discontinued device support, or third-party service interruptions.

14B.4 Biometric and Health Data

Connected Devices may transmit sensitive biometric and health data, including:

  • NOT Medical Devices: Most consumer wearables are not FDA-approved medical devices and should not be used for diagnosis or treatment
  • Accuracy Limitations: Wearable data may be inaccurate due to device limitations, improper use, or technical errors
  • Not for Medical Decisions: Do not make medical decisions based solely on wearable device data
  • Consult Professionals: Always consult healthcare professionals for medical advice, diagnosis, or treatment

14B.5 Data Privacy and Security

For detailed information about how we collect, use, and protect data from Connected Devices, see our Privacy Policy. Key points:

  • Biometric data is encrypted in transit and at rest
  • You control what data is synced and can disconnect devices anytime
  • We do not sell your biometric or health data
  • Data is retained according to legal requirements and your preferences
  • You can request deletion of synced data (subject to legal retention requirements)

14B.6 API Changes and Service Interruptions

Third-party integrations depend on external APIs and services. Glewell may:

  • Experience data syncing delays due to third-party API issues
  • Discontinue support for certain devices if APIs become unavailable
  • Modify integration features based on third-party changes
  • Temporarily disable integrations for security or technical reasons

We are not liable for interruptions, data loss, or functionality changes caused by third-party providers.

14C. Data Export and Portability

14C.1 Your Right to Data Export

You have the right to export your personal data from Glewell at any time. This includes:

  • Profile Information: Account details, preferences, settings
  • Health Data: Weight logs, body measurements, health metrics
  • Nutrition Data: Food logs, meal plans, calorie tracking history
  • Fitness Data: Workout logs, exercise history, fitness goals
  • Progress Data: Progress photos, measurements over time, achievement history
  • Community Data: Your posts, comments (excluding private messages from others)
  • Wearable Data: Synced data from connected devices

14C.2 Data Export Process

To request a data export:

  1. Navigate to Settings > Privacy & Data > Export My Data
  2. Select the data categories you wish to export
  3. Choose your preferred format (JSON, CSV, or PDF)
  4. Click "Request Export"
  5. You will receive an email when your export is ready (typically within 24-48 hours)
  6. Download link will be available for 14 days

14C.3 Data Included and Excluded

What's Included:

  • All data you created or uploaded
  • Data synced from your connected devices
  • System-generated insights based on your data
  • Your public profile information and community posts

What's NOT Included:

  • Proprietary algorithms or AI models
  • Other users' private content (their messages to you, their posts)
  • Glewell's internal analytics and metadata
  • Data from other users in shared challenges (only your own participation data)
  • Deleted or archived data beyond retention periods

14C.4 Data Portability to Other Services

You may use your exported data to:

  • Import into other health and fitness platforms
  • Share with healthcare providers
  • Analyze in your own tools and applications
  • Archive for personal records

Note: Glewell is not responsible for how third-party services handle your exported data. We recommend reviewing their privacy policies before uploading your data.

14C.5 Data Retention After Account Deletion

When you delete your account:

  • You have 30 days to export your data before permanent deletion begins
  • Personal data is deleted within 30-90 days (subject to legal retention requirements)
  • Some data may be retained longer for legal compliance (e.g., transaction records, DMCA notices)
  • Aggregated, anonymized data may be retained indefinitely for research and analytics
  • Public posts may remain visible if they were shared in community contexts (with your username removed)

15. Third-Party Services and Integrations

The Service may integrate with or link to third-party services, websites, applications, or content. We are not responsible for:

  • The availability, accuracy, or content of third-party services
  • Third-party privacy practices or terms of service
  • Any damages or losses caused by third-party services

Your use of third-party services is at your own risk and subject to their terms and policies.

15A. Notifications and Communications

15A.1 How We Communicate

We may send you notifications and communications through various channels:

  • Email: Account updates, security alerts, promotional offers, newsletters
  • In-App Notifications: Push notifications, banners, and alerts within the Service
  • SMS/Text Messages: Time-sensitive alerts (if you opt-in and provide phone number)
  • Service Announcements: In-app banners for critical updates
  • Website Notices: Pop-ups or banners on glewell.com

You can manage your notification preferences:

  • Email Preferences: Unsubscribe from marketing emails via the link in any email or through Settings > Notifications > Email Preferences
  • Push Notifications: Disable in Settings > Notifications > Push Notifications or through your device settings

  • No Medical Diagnosis: AI cannot diagnose medical conditions, illnesses, or injuries

Meal Plan Generation:

  • AI meal plans may not account for food allergies, intolerances, or medical dietary restrictions
  • Nutritional calculations are estimates and may not reflect actual food content
  • Portion recommendations may be too large or small for your individual needs
  • AI cannot replace personalized guidance from registered dietitians or nutritionists
  • Some meal plans may be culturally inappropriate or impractical for your situation
  • Always verify food safety, preparation methods, and ingredient compatibility

AI Coaching & Habit Recommendations:

  • AI coaching is automated and lacks the nuanced understanding of human coaches
  • Motivational messages are generic and may not resonate with your personal situation
  • Habit formation suggestions may not address underlying psychological or behavioral issues
  • AI cannot provide mental health support or therapy
  • Goal recommendations may be unrealistic or unsafe for certain individuals

Data Analysis & Predictions:

  • Weight predictions are estimates based on mathematical models, not guarantees
  • Body composition estimates may be significantly inaccurate
  • Calorie burn calculations can vary widely from actual expenditure
  • Risk assessments are NOT medical diagnoses and may be wrong

  • That AI coaching will help you achieve your goals

17.6 AI Training and Data Use

We use aggregated, anonymized user data to train and improve our AI models:

  • Your individual workout data, meal logs, and progress may be used (in anonymized form) to improve AI algorithms
  • AI models learn from collective user patterns to provide better recommendations
  • Personal identifiers are removed before data is used for AI training
  • You cannot opt-out of anonymized data use for AI improvement while using AI features

You agree to indemnify, defend, and hold harmless Glewell, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another

20. Termination and Suspension

20.1 Termination by You

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to premium features will end at the end of the paid period.

20.2 Termination by Glewell

We reserve the right to suspend, disable, or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to:

  • Breach of these Terms or Community Guidelines
  • Illegal activity or fraudulent conduct
  • Harassment, abuse, or harm to other users
  • Failure to pay subscription fees
  • Extended periods of account inactivity

20.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service immediately ends
  • Your User Content may be permanently deleted
  • You remain responsible for all charges incurred prior to termination
  • No refunds will be provided for unused subscription periods (except as outlined in Section 10)

21. Dispute Resolution

21.1 Informal Resolution Requirement

BEFORE INITIATING ANY LEGAL ACTION, YOU AGREE TO FIRST ATTEMPT TO RESOLVE ANY DISPUTE INFORMALLY.

Contact us at legal@glewell.com with a detailed description of the dispute. Both parties agree to negotiate in good faith for 60 days to reach a resolution.

21.2 No Class Actions

YOU AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

21.3 Time Limitation

Any claim or cause of action arising from the Service or these Terms must be filed within one (1) year after such claim arose, or it will be forever barred.
